Maybe you\u2019ve moved to Florida, and you\u2019re worried about sharks; or you\u2019ve bought property in Texas, where fire ants are common; or you\u2019ve retired to Arizona, where rattlesnakes abound. You want to protect your property and make sure that visitors are kept safe. What are your obligations?<\/p>\n<p><span style=\"font-weight: 400;\">Now, state and local laws vary, but the general baseline is, there are two categories of wild animals: wild animals kept in captivity (like circuses or alligator wrestling venues), and wild animals in nature (like bears or alligators). If you have captive wild animals, you have to take extreme precautions. For wild animals in nature, you have very few obligations.<\/span><br>\n<br>\n<b>Lions, Tigers, And Alligators, Oh My! <\/b> <br>\n<span style=\"font-weight: 400;\">Let\u2019s start with the first category: wild animals in captivity. If you keep a wild animal on the premises, like the lion at the<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=8029126257319546443&amp;q=animal+attack+%22strict+liability%22&amp;hl=en&amp;as_sdt=ffffffffffffe04\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400;\">International Automobile Show<\/span><\/a><span style=\"font-weight: 400;\">, it\u2019s your obligation to protect your patrons. No exceptions, no matter how tame you think the animal is. At the International Auto Show, a supposedly tame lion mauled a model working at the car show and the model sued. In that case, court ruled that the owner is usually liable for any harm caused by the animal, even if the owner thought the wild animal is docile. This applies to almost all kinds of wild animals, whether<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=1850203999093852420&amp;q=66+Cal.App.4th+1477&amp;hl=en&amp;as_sdt=6,33#[1]\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400;\">lions, tigers, bears, elephants, wolves, or monkeys<\/span><\/a><span style=\"font-weight: 400;\">. Wild animals are unpredictable and dangerous, so \u201c<\/span>one who keeps a tame bear upon his premises \u2026 is liable to anyone whom the bear may maul or bite, even though he has taken every precaution to control it<\/span><span style=\"font-weight: 400;\">.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This applies especially where you bring non-native wild animals outside of their normal ranges. (<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=2656083219799332851&amp;q=ferae+naturae&amp;hl=en&amp;as_sdt=ffffffffffffe04\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Canadian cougars don\u2019t normally live in Ohio<\/span><\/a><span style=\"font-weight: 400;\">, for example.) Because no one\u2019s expecting non-native animals, they pose a large hazard to the public. This means that you should take every safety precaution you can to protect visitors.<\/span><br>\n<br>\n<b>$5 Sign, $5 Million Lawsuit <\/b> <br>\n<span style=\"font-weight: 400;\">Now, as to wild animals in nature. When native wild animals attack within their native ranges,<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=17850347689430439245&amp;q=487+So.+2d+352&amp;hl=en&amp;as_sdt=ffffffffffffe06\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400;\">landowners aren\u2019t normally liable<\/span><\/a><span style=\"font-weight: 400;\">. But there\u2019s an exception, where exceptionally careless landowners can be held liable. When these three things apply, you can be sued for negligence:<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=12326372011965389923&amp;q=ferae+naturae&amp;hl=en&amp;as_sdt=ffffffffffffe04\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400;\">(1) you knew, or should have known, that there\u2019s a danger of wild animal attacks; (2) the danger of wild animal attacks is a hidden hazard that a visitor wouldn\u2019t have recognized until it was too late; and (3) you didn\u2019t reasonably try to protect them from that hazard.<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">In nearly all cases, wild animals in their natural habitats aren\u2019t \u201chidden hazards\u201d at all. For example, if you live in Texas and one of your guests catches Lyme disease from a tick bite, the sad truth is,<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=4682094519678385450&amp;q=ferae+naturae&amp;hl=en&amp;as_sdt=ffffffffffffe04\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400;\">ticks are native to Texas and it\u2019s the guest\u2019s responsibility to protect against them<\/span><\/a><span style=\"font-weight: 400;\">. The same goes for injuries caused by<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=8130593982496976495&amp;q=ferae+naturae&amp;hl=en&amp;as_sdt=ffffffffffffe04\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400;\">sharks in Florida<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=12326372011965389923&amp;q=ferae+naturae&amp;hl=en&amp;as_sdt=ffffffffffffe04\"> <span style=\"font-weight: 400;\">fire ants in Texas<\/span><\/a><span style=\"font-weight: 400;\">, or<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=7408501035911664613&amp;q=ferae+naturae&amp;hl=en&amp;as_sdt=ffffffffffffe04\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400;\">elk in Arizona<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There\u2019s one more thing you should know. If you do decide to protect your property against wild animals, you should make sure that you do a good job of it. The very act of taking precautions means that you (1) know there\u2019s a potential for wild animal attacks; and (2) recognize a visitor might not be aware of the danger. These safety measures can be very useful when tragedy strikes. &nbsp;For example, one Georgia homeowners association owned a lagoon, regularly removed alligators from its property, and warned its residents of the danger of alligator attacks. Then, when an alligator mauled an elderly woman to death,<\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=15575284851644042796&amp;q=georgia+alligator&amp;hl=en&amp;as_sdt=ffffffffffffe04\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400;\">the association was protected from the lawsuit filed by the woman\u2019s estate<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That\u2019s the gist of it. If you own wild animals, control them so they don\u2019t hurt your guests; if there is native wildlife around, you normally aren\u2019t responsible unless you know there\u2019s a hidden hazard and don\u2019t act on it.
