{"id":7883,"date":"2016-10-03T09:00:16","date_gmt":"2016-10-03T13:00:16","guid":{"rendered":"https:\/\/www.smartsignblog.com\/blog\/?p=7883"},"modified":"2020-07-16T06:09:22","modified_gmt":"2020-07-16T10:09:22","slug":"many-obvious-warnings-products","status":"publish","type":"post","link":"https:\/\/www.smartsign.com/blog\/many-obvious-warnings-products\/","title":{"rendered":"Why are there so many obvious warnings on products?"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Everyone has seen those slightly silly warning labels. \u201cDo not tip or rock vending machine.\u201d \u201cCaution: Coffee is hot.\u201d \u201cWarning: choking hazard.\u201d And sometimes you wonder, just why are these warning labels everywhere?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The short answer is, \u201cbecause it\u2019s the law.\u201d Under the law, product manufacturers have three major obligations to their customers: (1) design non-defective products, (2) manufacture them competently, and (3) warn the public of non-obvious product hazards.<\/span><\/p>\n<p><a href=\"https:\/\/www.mysafetysign.com\/fos\/choking-hazard-not-for-children-under-3-label-box\/sku-qc-haz34-750-box\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-7888\" src=\"https:\/\/www.smartsign.com/blog\/wp-content\/uploads\/2016\/09\/choking-hazard-label-qc-haz34-750-box-300x300.png\" alt=\"choking-hazard-label-qc-haz34-750-box\" width=\"235\" height=\"235\" srcset=\"https:\/\/www.smartsign.com/blog\/wp-content\/uploads\/2016\/09\/choking-hazard-label-qc-haz34-750-box-300x300.png 300w, https:\/\/www.smartsign.com/blog\/wp-content\/uploads\/2016\/09\/choking-hazard-label-qc-haz34-750-box-150x150.png 150w, https:\/\/www.smartsign.com/blog\/wp-content\/uploads\/2016\/09\/choking-hazard-label-qc-haz34-750-box-768x768.png 768w, https:\/\/www.smartsign.com/blog\/wp-content\/uploads\/2016\/09\/choking-hazard-label-qc-haz34-750-box.png 800w\" sizes=\"auto, (max-width: 235px) 100vw, 235px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">How this law developed is pretty interesting.\u00a0<\/span><a href=\"https:\/\/sites.la.utexas.edu\/judpro\/files\/2016\/02\/Winterbottom-v.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">In the 1800s, there had to be an actual contract between a product\u2019s manufacturer and the consumer for an injured consumer to be able to sue<\/span><\/a><span style=\"font-weight: 400;\">. But as the modern economy developed, it soon became apparent that it wasn\u2019t possible for individual consumers to judge <\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=13972799541821893527&amp;q=decker+v.+capps&amp;hl=en&amp;as_sdt=6,33\"><span style=\"font-weight: 400;\">how their products were made<\/span><\/a><span style=\"font-weight: 400;\"> anymore. Over the years, the courts <\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=16383315944612185169&amp;q=377+P.2d+897&amp;hl=en&amp;as_sdt=6,33\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">gradually transferred full responsibility for defects to manufacturers<\/span><\/a><span style=\"font-weight: 400;\">, culminating in a 1963 California case involving large damages for a defective lathe. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Over the years the manufacturers\u00a0got more and more obligations to <\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=9282117596940395408&amp;q=watkins+v.+ford+motor&amp;hl=en&amp;as_sdt=6,33\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">warn consumers of the unseen, potentially dangerous aspects of their products<\/span><\/a><span style=\"font-weight: 400;\">, including the \u201886 Ford Bronco\u2019s unfortunate habit of rolling over. This led to the proliferation of warning labels. The court\u2019s logic was, it would be unrealistic to expect individual consumers to carefully screen every single product they buy for potential hazards, so why not make it the manufacturer\u2019s responsibility to deal with that? \u00a0<\/span><\/p>\n<p>The trouble is, some consumers do dumb things.<\/p>\n<p><a href=\"https:\/\/www.mysafetysign.com\/create-own-osha-caution-sign\/saf-sku-s-3084\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-7889 \" src=\"https:\/\/www.smartsign.com/blog\/wp-content\/uploads\/2016\/09\/Custom-Caution-Sign-S-3084-215x300.gif\" alt=\"custom-caution-sign-s-3084\" width=\"195\" height=\"272\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">For example, most people know that cologne is mostly alcohol, alcohol is flammable, and lit candles are a source of fire. So it\u2019s not a good idea to mix alcohol and fire, unless you\u2019re in a fancy cocktail bar. <\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=8714859852588098111&amp;hl=en&amp;as_sdt=6&amp;as_vis=1&amp;oi=scholarr\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Naturally, two teenagers decided to spray cologne over a candle. One of them burned herself<\/span><\/a><span style=\"font-weight: 400;\">, and sued. She won, because that some consumers <\/span><i><span style=\"font-weight: 400;\">don\u2019t <\/span><\/i><span style=\"font-weight: 400;\">know that perfume is highly flammable and made of alcohol&#8211; but the manufacturer absolutely does. \u00a0<\/span><\/p>\n<p>But sometimes there\u2019s a really legitimate issue at stake, and the company really did mess up.<\/p>\n<p><span style=\"font-weight: 400;\">For example, <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Liebeck_v._McDonald%27s_Restaurants\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">in the much-maligned McDonald\u2019s coffee case<\/span><\/a><span style=\"font-weight: 400;\">, an elderly woman suffered third-degree burns and required skin grafts after spilling her McDonald\u2019s coffee. (Obviously, a coffee spill shouldn\u2019t cause third-degree burns or require skin grafts.
